1. About the Privacy Policy

The purpose of this policy is to notify the visitors of our website, journalists that send accreditation requests, visitors that send their information via contact form and/or buy tickets and other persons with the purposes and principles relating to processing of personal data in Tolminator d.o.o. 

This policy also further clarifies the conditions for consent, how long we keep your data, the rights of natural persons regarding the processing of personal data and the rights of natural persons in the event that the regulations on the safety of personal data are infringed. 

Per the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) the following information are part of this Policy:
• contact information of Tolminator d.o.o.,
• purposes, basis and types of processing of personal data,
• how long we keep personal data,
• rights of natural persons regarding the processing of personal data,
• right to file a complaint about the processing of personal data. 

2. Controller of personal data 

The controller of personal data is Tolminator d.o.o. which treats personal data in accordance with its legal and regulatory rules.

3. Personal data that Tolminator collects

Tolminator collects the following categories of personal data:

1. Data you submit yourself

• when you use the contact form,
• when you apply for accreditation,
• when you browse through our content, 
• when you buy tickets, 
• when you ask us questions. 

2. Data you create while using our services

• mostly when you post a question, comment or rate our events.    

4. The purposes and legal grounds for the processing of data   

In accordance with regulations on the protection of personal data Tolminator as the collector of personal data must ensure for any kind of transmission of personal data, that it is later possible to determine what categories of personal data were transmitted, to who, when and on which legal grounds, for which purpose and/or reasons and/or what kind of procedure, except if another law states otherwise.  

Processing necessary for the purpose of the legitimate interests pursued by Tolminator:

Tolminator can process data on the basis of the legitimate interest that it pursues or is pursued by a third party, except where such interests are overriden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child. When further usage of data is in question Tolminator performs an assesment in accordance to the General Data Protection Regulation (GDPR).

In accordance to GDPR direct marketing is a legitimate interest. 

On the basis of legitimate interest Tolminator can contact data subjects in order to determine their satisfaction with the services even when this is not strictly necessary. Tolminator weighs this interest with the interest of data subjects and does not contact those subject that have objected to this. 

Tolminator d.o.o. implements video surveillance as a preventive security measure on the festival Tolminator. On the implementation of video surveillance Tolminator in accordance with the applicable law, informs with a notice that is visibly and distinctly published in a way that allows the individual to be detected by its implementation at the latest before video surveillance begins to be implemented over him.

Based on legitimate interest Tolminator can proccess data in a strictly necessary and proportionate scope. 

Processing on the grounds of consent given by the data subject:

Tolminator may ask data subjects to give their consent to the processing of personal data needed to assess certain personal aspects of the data subject, e.g. the analysis of personal tastes, interests and behavior of a data subject (profiling) for the purpose of accommodated offers of services to the subject including informing, direct marketing and market research. In such cases the processing of personal data is performed in regards with the scope of personal data, intent and channels for informing which the data subject has agreed to, up untill the withdrawal of consent. The informing about the processing of personal data is performed in the way which the data subject decided on in the consent.

Consent is valid only when given by a clear affirmative act establishing a freely given, specific, informed and unambiguous indication of the data subject’s agreement to the processing of personal data relating to him or her, such as by a written statement, including by electronic means, or an oral statement. 

The data subject has the right to withdraw his or her consent at any time in the same way that it was given, or in another way determined by Tolminator whereas Tolminator has the right to identify such a subject. Withdrawal or change of consent only affects data which is processed on the grounds of consent. The last data subject’s consent that Tolminator receives is valid.  The revocation of consent does not effect the lawfulness of processing which was carried out on the grounds of consent unill its revocation.

5. How long we keep your personal data?

We store your personal data as long as they are necessary for the realization of the intent of their processing or untill you revoke your consent for the processing of personal data for individual or all purposes of processing. 

Clearance data and connected contact data about data subjects can be stored untill full payment and/or as long as the limitation periods of each individual claim are running (one to five years). Receipts are stored for 10 years after the end of the year in which they were issued in accordance with the Value Added Tax Act. 

Personal data processed on the grounds of your consent is stored for the shortest possible time period or untill you revoke your consent. The revocation of consent does not effect the lawfulness of processing which was carried out on the grounds of consent unill its revocation. After the purpose of processing is fulfilled the data is deleted, destroyed, blocked or made anonymous, unless law states otherwise. 

6. Who processes personal data?

Personal data of data subjects can be processed by the following: 

• members of Tolminator (in line with their contractual obligations and regulations),
• public authorites when exercising their legal obligations (e.g. Financial Administration of the Republic of Slovenia),
• contractual processors of personal data with which Tolminator decided a contract on the processing of personal data, 
• other persons if you have given your consent,
• other persons only if they have a legal basis.

In the above mentioned users are also companies that provide Tolminator with technical support (e.g. webmasters, developers of software solutions, etc.) and persons and/or companies that provide Tolminator with services such as accounting, postal services, legal services, etc. 

Some organizations and/or companies which are our contractual processors may have their seat outside the EU, in countries that don’t have laws that protect personal data in the same way that the laws in the EU and/or Slovenia do. If your personal data is transmitted to third countries (outside EU) we will ensure proper measures for the safety of personal data and basic rights and liberties of data subjects, according to EU and Member State regulations and this Privacy Policy, by using suitable mechanisms like binding business rules, standard contractual clauses etc. 

7. Rights of natural persons on which personal data apply

Tolminator provides information on action taken on a request about the rights to the data subject without undue delay and in any event within one month of receipt of the request. That period my be extended by two further months where necessary, taking into account the complexity and number of requests. Tolminator shall inform the data subject of any such extensions within one month of receipt of the request, together with the reasons for the delay.

Where the data subject makes the request by electronic form means, the information shall be provided by electronic means where possible, unless otherwise requested by the data subject. 

Where Tolminator has reasonable doubts concerning the identity of the natural person making the request about one of his/her rights, Tolminator may request the provision of additional information necessary to confirm the identity of the data subject. 

Where requests from a data subject are manifestly unfounded or excessive, in particular because of their repetitive character, Tolminator may either: 

– charge a reasonable fee taking into account the administrative costs of providing the information or communication or taking the actions requested; or
– refuse to act on the request.

Tolminator grants the following rights to natural persons regarind the processing of personal data:
a) right of access,
b) right of rectification,
c) right to be forgotten,
d) right to restriction of processing,
e) right of portability,
f) right to object.

a) right to access

The data subject has the right to obtain from Tolminator confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and the following information:

  • the purposes of the processing,
  • the categories of personal data concerned,
  • the recipients or categories of recipient to whom the personal data have been or will be disclosed,
  • where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period,
  • the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing,
  • the right to lodge a complaint with a supervisory authority,
  • where the personal data are not collected from the data subject, any available information as to their source,
  • the existence of automated decision-making, including profiling, and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.

If a data subject demands so, Tolminator will provide a copy of the personal data undergoing processing. For any further copies requested by the data subject, Tolminator may charge a reasonable fee based on administrative costs. 

b) right to rectification

The data subject has the right to obtain from Tolminator without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data has the right to have incomplete personal data completed, including by means of providing a supplementary statement.

c) right to erasure

The data subject has the right to obtain from Tolminator the erasure of personal data concerning him or her without undue delay and Tolminator has the obligation to erase personal data without undue delay where one of the following grounds applies:

  • the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
  • the data subject withdraws consent on which the processing is based and where there is no other legal ground for the processing;
  • the data subject objects to the processing pursuant and there are no overriding legitimate grounds for the processing, 
  • the personal data have been unlawfully processed;
  • the personal data have to be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject;
  • the personal data have been collected in relation to the offer of information society services,

Where Tolminator has made the personal data public and is obliged to erase the personal data, Tolminator taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform controllers which are processing the personal data that the data subject has requested the erasure by such controllers of any links to, or copy or replication of, those personal data.

d) right to restriction of processing

The data subject has the right to obtain from Tolminator restriction of processing where one of the following applies:

  • the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data;
  • the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead;
  • Tolminator no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims;
  • the data subject has objected to processing pending the verification whether the legitimate grounds of the controller override those of the data subject.

e) right of portability

The data subject has the right to receive the personal data concerning him or her, which he or she has provided to Tolminator in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, where:

 – the processing is based on consent,
– the processing is carried out by automated means.

f) right to object

The data subject has the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her. Tolminator shall no longer process the personal data unless it demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims. Where personal data are processed for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing, which includes profiling to the extent that it is related to such direct marketing. Where the data subject objects to processing for direct marketing purposes, the personal data shall no longer be processed for such purposes.

You can exercise the above stated rights with a written demand addressed to Tolminator d.o.o., Kapiteljska ulica 9, 1000 Ljubljana, Slovenia or via e-mail info@tolminator.com. In the same way you can permanently or temporarely, completely or partially cancel your consent for the processing of personal data, if you have given such a consent. 

8. Right to complaint

In Tolminator we strive to protect your personal data with dilligence and appropriate technological and organizational means of transmission protection and filing of personal and other confidential data. Nevertheless we would like to inform you that you have the right to lodge a complaint if you feel that your personal data is not processed according to the rules on protection of personal data.  

Data subjects can lodge a complaint about the processing of personal data via e-mail info@tolminator.com or by mail on Tolminator d.o.o., Kapiteljska ulica 9, 1000 Ljubljana, Slovenia.

Additionally data subjects on which personal data apply may lodge a complaint directly to the supervisory authority – Informacijski pooblaščenec RS, Dunajska 22, 1000 Ljubljana, Slovenia – if they feel their personal data is not processed according to Union or Member state rules on protection of personal data.  

If a data subject exercised his or her right to access at Tolminator and feels that he or she did not receive the right data or did not receive all the data, he or she can lodge a complaint to Tolminator before lodging a complaint to the supervisory authority, in 15 days. Tolminator must decide on the new complaint in five working days. 

9. Ensuring accurate, complete and up-to-date data 

Tolminator strives to ensure accurate and up-to-date personal data which can be achieved in line with regulations and/or data subjects’ consent. Complete and up-to-date data can only be used for purposes determined by this Policy and no other means unless you have given your consent. 

Tolminator is aware that the privacy of our users is crucial, therefore we treat their personal data with care and dilligence and in accordance with rules and regulations of the Republic of Slovenia and internal rules of Tolminator. Accesss to personal data is granted only to authorized personnel and contractual processors and in the scope and intent that is needed to to provide our services.

10. Changes of the Privacy Policy

Tolminator reserves the right to occasionaly update the Privacy Policy, based on feedback from users and/or in the event the regulations are changed. The change of the Policy is marked with the date of its last update. 

In the case of major updates or changes of how Tolminator uses personal data, data subject will be notified about this via a notice on our website or by e-mail (if a consent for this is given), beforehand. 

Tolminator recomends to users that they regularely inspect this policy and be informed on how Tolminator protects their privacy.

12. Validity of the Privacy Policy

This Policy comes to effect on 15.07.2024 and is in use until its revoked or its provisions are changed.

1. O politiki zasebnosti

Namen te politike je obvestiti obiskovalce naše spletne strani, novinarje, ki pošiljajo prošnje za akreditacijo, obiskovalce, ki pošiljajo svoje podatke prek kontaktnega obrazca in/ali kupujejo vstopnice ter druge osebe o namenu in načelih, povezanih z obdelavo osebnih podatkov v podjetju Tolminator d.o.o.

Ta politika prav tako dodatno pojasnjuje pogoje za privolitev, koliko časa hranimo vaše podatke, pravice fizičnih oseb v zvezi z obdelavo osebnih podatkov in pravice fizičnih oseb v primeru kršitve predpisov o varnosti osebnih podatkov.

V skladu z Uredbo (EU) 2016/679 Evropskega parlamenta in Sveta z dne 27. aprila 2016 o varstvu osebnih podatkov in o prostem pretoku teh podatkov ter razveljavitvi Direktive 95/46/ES (Splošna uredba o varstvu podatkov) so naslednje informacije del te politike:

Upravljavec osebnih podatkov je Tolminator d.o.o., ki obdeluje osebne podatke v skladu z veljavnimi zakonodajnimi in regulativnimi pravili.

3. Osebni podatki, ki jih zbira Tolminator

Tolminator zbira naslednje kategorije osebnih podatkov:

1. Podatki, ki jih sami posredujete

• ko uporabljate kontaktni obrazec,

• ko se prijavite za akreditacijo,

• ko brskate po našem vsebinskem gradivu,

• ko kupujete vstopnice,

• ko nam postavljate vprašanja.

2. Podatki, ki jih ustvarite med uporabo naših storitev

• predvsem, ko postavite vprašanje, komentirate ali ocenjujete naše dogodke.

4. Namen in pravne osnove za obdelavo podatkov

V skladu s predpisi o varstvu osebnih podatkov mora Tolminator kot zbiratelj osebnih podatkov zagotoviti, da je mogoče za vsak prenos osebnih podatkov določiti, katere kategorije osebnih podatkov so bile prenesene, komu, kdaj in na katerih pravnih osnovah, za kakšen namen in/ali razlog in/ali kakšen postopek, razen če zakon določa drugače.

Obdelava, potrebna za dosego zakonitih interesov, ki jih zasleduje Tolminator:

Tolminator lahko obdeluje podatke na podlagi zakonitega interesa, ki ga zasleduje ali ga zasleduje tretja oseba, razen kadar so ti interesi prevzeti s strani interesov ali temeljnih pravic in svoboščin osebe, katere podatki so obdelani, ki zahtevajo zaščito osebnih podatkov, zlasti kadar je oseba, katere podatki so obdelani, otrok. Ko je vprašanje nadaljnje uporabe podatkov, Tolminator izvede oceno v skladu s Splošno uredbo o varstvu podatkov (GDPR).

V skladu z GDPR je neposredno trženje zakonit interes.

Na podlagi zakonitega interesa lahko Tolminator stopi v stik z osebami, katere podatki so obdelani, da ugotovi njihovo zadovoljstvo s storitvami, tudi ko to ni nujno potrebno. Tolminator upošteva ta interes v primerjavi z interesi oseb in ne stopi v stik z osebami, ki so temu nasprotovale.

Tolminator d.o.o. izvaja video nadzor kot preventivno varnostno ukrep na festivalu Tolminator. Ob izvajanju video nadzora Tolminator v skladu z veljavno zakonodajo obvešča z obvestilom, ki je vidno in jasno objavljeno na način, ki omogoča posamezniku, da je zaznan z izvajanjem, najkasneje pred začetkom video nadzora.

Na podlagi zakonitega interesa lahko Tolminator obdeluje podatke v strogo potrebnem in sorazmerném obsegu.

Obdelava na podlagi privolitve, ki jo da posameznik:

Tolminator lahko zahteva, da posamezniki dajo svojo privolitev za obdelavo osebnih podatkov, potrebnih za oceno določenih osebnih vidikov posameznika, npr. analizo osebnih okusov, interesov in vedenja posameznika (profiliranje) za namen prilagojenih ponudb storitev, vključno z obveščanjem, neposrednim trženjem in tržnimi raziskavami. V takih primerih se obdelava osebnih podatkov izvaja v skladu z obsegom osebnih podatkov, namenom in kanali obveščanja, s katerimi se je posameznik strinjal, do preklica privolitve. Obveščanje o obdelavi osebnih podatkov poteka na način, ki ga je posameznik določil v privolitvi.

Privolitev je veljavna le, če je dana z jasnim pozitivnim dejanjem, ki vzpostavi prosto dano, specifično, informirano in nedvoumno kazanje soglasja posameznika za obdelavo osebnih podatkov, ki se nanašajo nanj, bodisi z pisno izjavo, vključno z elektronskimi sredstvi, bodisi z ustno izjavo.

Posameznik ima pravico kadar koli preklicati svojo privolitev na enak način, kot je bila dana, ali na drug način, ki ga določi Tolminator, pri čemer ima Tolminator pravico identificirati takšno osebo. Preklic ali sprememba privolitve vpliva le na podatke, obdelane na podlagi privolitve. Veljavna je zadnja privolitev posameznika, ki jo Tolminator prejme. Preklic privolitve ne vpliva na zakonitost obdelave, ki je bila opravljena na podlagi privolitve do njenega preklica.

5. Kako dolgo hranimo vaše osebne podatke?

Vaše osebne podatke hranimo, dokler so potrebni za dosego namena njihove obdelave ali dokler ne prekličete svoje privolitve za obdelavo osebnih podatkov za posamezne ali vse namene obdelave.

Podatki o obračunu in povezani kontaktni podatki o posameznikih se lahko hranijo do popolnega plačila in/ali dokler trajajo zastaralni roki vsakega posameznega zahtevka (eno do pet let). Računi se hranijo 10 let po koncu leta, v katerem so bili izdani, v skladu z Zakonom o davku na dodano vrednost.

Osebni podatki, obdelani na podlagi vaše privolitve, se hranijo najkrajši možni čas ali dokler ne prekličete svoje privolitve. Preklic privolitve ne vpliva na zakonitost obdelave, ki je bila opravljena na podlagi privolitve do njenega preklica. Po izpolnitvi namena obdelave se podatki izbrišejo, uničijo, blokirajo ali anonimizirajo, razen če zakon določa drugače.

6. Kdo obdeluje osebne podatke?

Osebne podatke posameznikov lahko obdelujejo naslednji subjekti:

• člani podjetja Tolminator (v skladu z njihovimi pogodbenimi obveznostmi in predpisi),

• javni organi pri izvajanju svojih zakonskih obveznosti (npr. Finančna uprava Republike Slovenije),

• pogodbeni obdelovalci osebnih podatkov, s katerimi je Tolminator sklenil pogodbo o obdelavi osebnih podatkov,

• druge osebe, če ste podali svojo privolitev,

• druge osebe le, če imajo pravno podlago.

Med zgoraj omenjenimi subjekti so tudi podjetja, ki Tolminatorju zagotavljajo tehnično podporo (npr. skrbniki spletnih strani, razvijalci programske opreme itd.) ter osebe in/ali podjetja, ki Tolminatorju zagotavljajo storitve, kot so računovodstvo, poštne storitve, pravne storitve itd.

Nekatere organizacije in/ali podjetja, ki so naši pogodbeni obdelovalci, imajo lahko sedež izven EU, v državah, kjer zakoni ne varujejo osebnih podatkov na enak način kot zakoni v EU in/ali Sloveniji. Če bodo vaši osebni podatki preneseni v tretje države (izven EU), bomo zagotovili ustrezne ukrepe za varnost osebnih podatkov ter osnovne pravice in svoboščine posameznikov v skladu z uredbami EU in članicami ter to Politiko zasebnosti, z uporabo ustreznih mehanizmov, kot so obvezna poslovna pravila, standardne pogodbene klavzule itd.

7. Pravice posameznikov, na katere se nanašajo osebni podatki

Tolminator zagotavlja informacije o ukrepih, sprejetih v zvezi z zahtevami glede pravic posameznikov, brez nepotrebnega odlašanja in v vsakem primeru v roku enega meseca od prejema zahteve. Ta rok se lahko podaljša za še dva meseca, če je to potrebno, ob upoštevanju zapletenosti in števila zahtev. Tolminator bo posameznika obvestil o takšnih podaljšanjih v enem mesecu od prejema zahteve, skupaj z razlogi za zamudo.

Tolminator sprejema zahteve glede pravic posameznikov preko e-pošte na info@tolminator.com ali po pošti na naslov Tolminator d.o.o., Kapiteljska ulica 9, 1000 Ljubljana, Slovenija.

Če posameznik vloži zahtevo z elektronskimi sredstvi, bodo informacije posredovane elektronsko, če je to mogoče, razen če posameznik zahteva drugače.

Če ima Tolminator utemeljene dvome o identiteti posameznika, ki vloži zahtevo glede ene izmed njegovih pravic, lahko Tolminator zahteva dodatne informacije za potrditev identitete posameznika.

Če so zahteve posameznika očitno neutemeljene ali pretirane, zlasti zaradi njihove ponavljajoče narave, lahko Tolminator:

– zaračuna razumno pristojbino, ob upoštevanju administrativnih stroškov zagotavljanja informacij ali komunikacije ali ukrepanja na zahtevo; ali

– zavrne ukrepanje na zahtevo.

Tolminator posameznikom priznava naslednje pravice v zvezi z obdelavo osebnih podatkov:

a) pravica do dostopa,

b) pravica do popravka,

c) pravica do izbrisa,

d) pravica do omejitve obdelave,

e) pravica do prenosa podatkov,

f) pravica do ugovora.

a) pravica do dostopa

Posameznik ima pravico od Tolminatorja pridobiti potrditev, ali se osebni podatki, ki se nanašajo nanj, obdelujejo, ter, če je tako, dostop do osebnih podatkov in naslednjih informacij:

– nameni obdelave,

– kategorije osebnih podatkov, ki so vključeni,

– prejemniki ali kategorije prejemnikov, katerim so bili osebni podatki razkriti ali bodo razkriti,

– kjer je mogoče, predvideno obdobje, za katerega bodo osebni podatki shranjeni, ali, če to ni mogoče, merila, uporabljena za določitev tega obdobja,

– obstoj pravice, da od upravljavca zahteva popravek ali izbris osebnih podatkov ali omejitev obdelave osebnih podatkov, ki se nanašajo na njega, ali da se upre takšni obdelavi,

– pravico vložiti pritožbo pri nadzornem organu,

– kjer osebni podatki niso bili zbrani od posameznika, morebitne razpoložljive informacije o njihovem viru,

– obstoj avtomatiziranega odločanja, vključno s profiliranjem, ter vsaj v teh primerih smiselne informacije o vključeni logiki, kot tudi pomen in predvidene posledice takšne obdelave za posameznika.

Če posameznik to zahteva, bo Tolminator zagotovil kopijo obdelovanih osebnih podatkov. Za morebitne dodatne kopije, ki jih zahteva posameznik, lahko Tolminator zaračuna razumno pristojbino na podlagi administrativnih stroškov.

b) pravica do popravka

Posameznik ima pravico, da od Tolminatorja brez nepotrebnega odlašanja pridobi popravek netočnih osebnih podatkov, ki se nanašajo nanj. Ob upoštevanju namenov obdelave ima posameznik pravico dopolniti nepopolne osebne podatke, vključno z dodatno izjavo.

c) pravica do izbrisa

Posameznik ima pravico, da od Tolminatorja pridobi izbris osebnih podatkov, ki se nanašajo nanj, brez nepotrebnega odlašanja, Tolminator pa je dolžan izbrisati osebne podatke brez nepotrebnega odlašanja, kadar velja enega od naslednjih razlogov:

– osebni podatki niso več potrebni v povezavi z nameni, za katere so bili zbrani ali drugače obdelovani,

– posameznik umakne privolitev, na kateri temelji obdelava, in ni druge pravne podlage za obdelavo,

– posameznik ugovarja obdelavi, pri čemer ni prevladujočih legitimnih razlogov za obdelavo,

– osebni podatki so bili obdelani nezakonito,

– osebni podatki morajo biti izbrisani zaradi izpolnjevanja zakonske obveznosti v pravu Unije ali članice, kateri je upravljavec podvržen,

– osebni podatki so bili zbrani v zvezi z nudenjem storitev informacijske družbe.

Če je Tolminator osebne podatke že javno objavil in je dolžan izbrisati osebne podatke, bo Tolminator ob upoštevanju razpoložljive tehnologije in stroškov izvedbe sprejel razumne ukrepe, vključno s tehničnimi ukrepi, da obvesti upravljavce, ki obdelujejo osebne podatke, da je posameznik zahteval izbris morebitnih povezav do teh osebnih podatkov, kopij ali njihovih replik.

d) pravica do omejitve obdelave

Posameznik ima pravico, da od Tolminatorja pridobi omejitev obdelave, kadar velja enega od naslednjih pogojev:

– točnost osebnih podatkov je sporna, za obdobje, ki omogoča upravljavcu preverjanje točnosti osebnih podatkov,

– obdelava je nezakonita in posameznik nasprotuje izbrisu osebnih podatkov ter zahteva omejitev njihove uporabe,

– Tolminator osebnih podatkov ne potrebuje več za namene obdelave, vendar so ti podatki potrebni posamezniku za uveljavljanje, izvajanje ali zaščito pravnih zahtevkov,

– posameznik je ugovarjal obdelavi, dokler se ne preveri, ali prevladujejo legitimni razlogi upravljavca pred tistimi posameznika.

e) pravica do prenosa podatkov

Posameznik ima pravico prejeti osebne podatke, ki se nanašajo nanj, katere je posredoval Tolminatorju, v strukturirani, pogosto uporabljeni in strojno berljivi obliki ter imeti pravico, da te podatke prenese drugemu upravljavcu brez ovir s strani upravljavca, kateremu so bili osebni podatki posredovani, kadar:

– obdelava temelji na privolitvi,

– obdelava poteka z avtomatiziranimi sredstvi.

f) pravica do ugovora

Posameznik ima pravico, da kadarkoli, na podlagi posebnih okoliščin, ugovarja obdelavi osebnih podatkov, ki se nanašajo nanj. Tolminator ne bo več obdeloval osebnih podatkov, razen če dokaže prepričljive legitimne razloge za obdelavo, ki presegajo interese, pravice in svoboščine posameznika ali so potrebni za uveljavljanje, izvajanje ali zaščito pravnih zahtevkov. Če se osebni podatki obdelujejo za namene neposrednega trženja, ima posameznik pravico kadarkoli ugovarjati obdelavi osebnih podatkov, ki se nanašajo nanj, za takšno trženje, vključno s profiliranjem, kolikor je to povezano s takim neposrednim trženjem. Če posameznik ugovarja obdelavi za namene neposrednega trženja, osebni podatki ne bodo več obdelovani za te namene.

Zgornje navedene pravice lahko uveljavljate z pisno zahtevo naslovljeno na Tolminator d.o.o., Kapiteljska ulica 9, 1000 Ljubljana, Slovenija ali preko e-pošte info@tolminator.com. Na enak način lahko trajno ali začasno, v celoti ali delno prekličete svojo privolitev za obdelavo osebnih podatkov, če ste jo dali.

8. Pravica do pritožbe

V Tolminatorju si prizadevamo za zaščito vaših osebnih podatkov z vestnostjo ter ustreznimi tehnološkimi in organizacijskimi sredstvi za zaščito prenosa in shranjevanja osebnih in drugih zaupnih podatkov. Kljub temu vas obveščamo, da imate pravico vložiti pritožbo, če menite, da vaši osebni podatki niso obdelovani v skladu s pravili o zaščiti osebnih podatkov.

Posamezniki lahko vložijo pritožbo glede obdelave osebnih podatkov preko e-pošte info@tolminator.com ali po pošti na naslov Tolminator d.o.o., Kapiteljska ulica 9, 1000 Ljubljana, Slovenija.

Poleg tega lahko posamezniki, na katere se nanašajo osebni podatki, vložijo pritožbo neposredno pri nadzornem organu – Informacijski pooblaščenec RS, Dunajska 22, 1000 Ljubljana, Slovenija – če menijo, da njihovi osebni podatki niso obdelovani v skladu z zakonodajo Unije ali članic o zaščiti osebnih podatkov.

Če posameznik uveljavlja svojo pravico do dostopa pri Tolminatorju in meni, da ni prejel pravih podatkov ali vseh podatkov, lahko vloži pritožbo pri Tolminatorju pred vložitvijo pritožbe pri nadzornem organu, v roku 15 dni. Tolminator mora odločiti o novi pritožbi v petih delovnih dneh.

9. Zagotavljanje natančnih, celovitih in ažurnih podatkov

Tolminator si prizadeva za zagotavljanje natančnih in ažurnih osebnih podatkov, kar je mogoče doseči v skladu s predpisi in/ali privolitvijo posameznikov. Celoviti in ažurni podatki se lahko uporabljajo le za namene, določene s to Politiko, in ne za druge namene, razen če ste dali svojo privolitev.

Tolminator je seznanjen, da je zasebnost naših uporabnikov ključna, zato njihova osebne podatke obravnavamo skrbno in vestno ter v skladu s pravili in predpisi Republike Slovenije ter notranjimi pravili Tolminatorja. Dostop do osebnih podatkov imajo le pooblaščeni zaposleni in pogodbeni obdelovalci ter v obsegu in namenu, ki sta potrebna za zagotavljanje naših storitev.

10. Spremembe Politike zasebnosti

Tolminator si pridržuje pravico, da občasno posodobi Politiko zasebnosti, na podlagi povratnih informacij uporabnikov in/ali v primeru sprememb predpisov. Sprememba Politike je označena z datumom zadnje posodobitve.

V primeru večjih posodobitev ali sprememb v načinu, kako Tolminator uporablja osebne podatke, bo posameznik o tem obveščen z obvestilom na naši spletni strani ali preko e-pošte (če je bila dana privolitev), vnaprej.

Tolminator priporoča uporabnikom, da redno pregledujejo to politiko in se seznanijo, kako Tolminator varuje njihovo zasebnost.

Ta Politika začne veljati 15.07.2024 in velja, dokler ni preklicana ali dokler niso spremenjeni njeni določili.
